The people of Amankpaka Community in Ugwuogo Nike, Enugu East LGA, have heaved a collective sigh of relief following a critical judgment from the Enugu State High Court, which stakeholders say saved their community from a looming crisis.
At the center of the legal storm was suit No. CME/288/2021, filed by Chief Festus Oguegbe Anieto against Hon. Gab Onu & 5 others. The dispute centered on attempts to unilaterally reconstitute the community’s Power of Attorney — a move many felt violated the community’s constitution and threatened its internal democratic structure.
The earlier ruling by a magistrate court, which dismissed the case on technical grounds, sparked outrage and fears of a breakdown in communal trust. But the plaintiff, Chief Oguegbe — who also serves as General Secretary of the Amankpaka General Assembly — took the matter to the High Court, seeking justice for the people.
In a powerful judgment delivered Hon. Justice R. N. Orji reversed the lower court’s decision and granted all reliefs sought by the appellant, ruling that:
- The lower court lacked jurisdiction “ab initio” to entertain the matter
- The defendants acted outside the constitution of the Amankpaka community
- The Elders in Council and General Assembly remain the only lawful bodies empowered to manage the community’s Power of Attorney
“This judgment is not just a legal win — it’s a victory for peace, tradition, and proper leadership. Without it, our community was headed for a serious internal conflict.”
He further added, “There’s now a ray of light, and the people are hopeful. This is a turning point.”
This judgment sends a strong message about the importance of following due process in local governance and respecting communal constitutions. It also highlights the power of the judiciary to restore order and uphold community rights.
